Terms & Conditions
These Terms & Conditions ("Terms") are a contract between you and Bookmint ("Bookmint", "we", "us", "our"), the provider of the Bookmint website at thebookmint.com and the Bookmint book-design application (together, the "Service"). By using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
1Who can use Bookmint
You must be at least 16 years old (or the age of digital consent where you live) to use the Service. By using it, you confirm you can enter into this agreement.
2What Bookmint is
Bookmint is a browser-based tool that turns manuscripts into print-ready PDFs and ebooks. It runs in your web browser. Your manuscripts and projects are processed and stored locally on your device — they are not uploaded to us. This is a privacy benefit, but it also means the safety of your work depends on your device and browser, and on you keeping backups.
3Beta service — provided "as is"
The Service is provided on a beta, "as is" and "as available" basis. We don't promise it will be uninterrupted, error-free, secure, or fit for any particular purpose. Features may change or be removed, and the Service may be unavailable at times. You use it at your own risk.
4Your work and backups
- You keep full ownership of everything you write and create in Bookmint. We claim no rights over your books.
- Because your work is stored in your browser, it can be lost if you clear your browser data, use a different device or browser, use private/incognito mode, or if a bug or your device causes a problem.
- You are responsible for backing up your work. Export or download your files regularly.
- To the fullest extent permitted by law, we are not responsible or liable for any loss, corruption, or unavailability of your work, files, or data.
5Your content and your responsibilities
You are solely responsible for the content you create, upload, or publish using the Service. You agree that you:
- own, or have the necessary rights and permissions for, all text, images, fonts, and other material you use;
- will not create or distribute content that is unlawful, infringing, defamatory, obscene, hateful, harassing, or that exploits or endangers minors;
- will not use the Service to infringe anyone's intellectual property, privacy, or other rights;
- are responsible for complying with the rules and requirements of any store or service you publish to (for example Amazon KDP, IngramSpark, Apple Books, Kobo, Draft2Digital).
6Acceptable use
When using the Service, you must not:
- break any applicable law or regulation;
- copy, reproduce, resell, rent, sublicense, or redistribute the Service or its code, design, or templates;
- reverse-engineer, decompile, or attempt to extract the source code, except where the law expressly allows it;
- deliberately interfere with, disrupt, overload, damage, or attempt to break the Service, or introduce malware or harmful code;
- attempt to gain unauthorised access to the Service, other users, or any systems or networks;
- remove, obscure, or bypass any notices, watermarks, or access controls (including on the free edition);
- use the Service to build or train a competing product.
7Intellectual property
The Service — including its software, code, design, layout, templates, and the Bookmint name and logo — belongs to us or our licensors and is protected by law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for creating your own books. You keep all rights to the books you make. The free edition may add a watermark or limit certain exports; a paid licence removes these.
8Payments and licences
Some features require a paid licence, sold through Gumroad. Prices are shown before purchase. A licence is a one-time purchase for personal use. You don't have to pay to try Bookmint — it's free to use, and you only need a licence when you want to export a version without the watermark. Because you can try everything before you buy, and because a licence is delivered instantly as a digital good, all sales are final and we do not offer refunds. (We may change how this works in future.) Payments are processed by Gumroad under their own terms; we never see or store your card details.
9Third-party services
The Service may link to or interact with third parties (such as publishing stores, fonts, or payment providers). We don't control and aren't responsible for third-party services, their content, or their terms. Your use of them is at your own risk and subject to their agreements.
10No warranty
To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will meet your needs, be error-free, or that files it produces will be accepted by any particular printer or store.
11Limitation of liability
You use the Service entirely at your own risk. To the fullest extent permitted by law, we exclude all liability to you arising from or connected with the Service or these Terms — including, without limitation, any loss of work, files, or data, lost profits, revenue, savings, or goodwill, and any indirect, incidental, special, or consequential loss — whether in contract, tort (including negligence), or otherwise, and whether or not the loss was foreseeable.
If, despite the above, we are found to have any liability that cannot lawfully be excluded, our total liability to you for all claims connected with the Service will not exceed the total amount you have paid us for the Service (which may be nothing).
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — for example, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any statutory rights you have as a consumer that cannot be excluded. Those rights are not affected by these Terms.
12Indemnity
You agree to reimburse us for any reasonable losses, costs, or claims we suffer arising from your breach of these Terms or your misuse of the Service, including any content you create or publish.
13Privacy
Bookmint is built to keep your manuscripts on your device — we don't upload or store the books you write, and we don't use advertising or behavioural-analytics trackers. The limited information we do handle (such as your name and email from a licence purchase, or a message you send us) is explained in our Privacy Policy.
14Suspension and changes
We may change, suspend, or withdraw all or part of the Service at any time, and we may update these Terms as the Service develops. If we make material changes, we'll update the date at the top of this page. Continuing to use the Service after changes means you accept the updated Terms. We may suspend or end your access if you break these Terms.
15Governing law
These Terms are governed by the laws of England & Wales, and the courts of England & Wales have exclusive jurisdiction, except where your local consumer law gives you the right to bring proceedings elsewhere.
